Will of John Mayne, butcher, 1800 (proved 1803)

This is the last Will and Testament of me John Mayne of Winslow in the County of Bucks Butcher made in manner following (that is to say) First I will and direct that all my just Debts  Funeral Charges and the Charges of proving this my Will shall be fully paid and satisfied and after full payment thereof I give and devise unto my Daughter Alice Mayne all and every my Messuages Cottages Farms Lands Tenements and Hereditaments whatsoever situate and being in Winslow aforesaid and Grandborough in the said County of Bucks or elsewhere in the Kingdom of Great Britain both Freehold and Copyhold the Copyhold parts whereof I have surrendered to the use of my Will to hold the same and every part thereof unto my said Daughter Alice Mayne her Heirs and Assigns forever subject nevertheless and I do hereby charge all my said Messuages . . . and Real Estate to and with the payment of all and every the Legacies or Sums of Money hereinafter by me given and bequeathed or so much thereof as my personal Estate should be deficient to pay and satisfy I give and bequeath unto my Son William Mayne of Swanbourne in the said County of Bucks the sum of Twenty pounds of lawful money of Great Britain I give and bequeath unto my Son Robert Mayne of Winslow aforesaid the Sum of one hundred and forty pounds of  \like/ lawful Money Also I give and bequeath unto my Son Oliver of Winslow aforesaid  the Sum of one hundred and Twenty pounds . . . Also I give and bequeath unto my daughter Ann Cleaver Wife of Samuel Cleaver of the Parish of St Giles in the Fields in the County of Middlesex Soap Manufacturer the Sum of Fifty pounds . . .  All which Legacies or Sums of Money I will and direct shall be paid within twelve Calendar Months next after my decease Also I give and bequeath unto my Grandson John Harris and my Granddaughter Sarah Harris Son and Daughter of my late Daughter Dorothy Harris deceased the Sum of fifty pounds a piece to be paid to them when they shall respectively attain their Ages of Twenty one years Also I give and bequeath unto my Grand Children John Robert Margaret and Rebecca Mayne Sons and Daughters of my said Son William Mayne the Sum of Twenty pounds a piece . . . to be paid to them when they shall respectively attain the Ages of Twenty one years and all the Rest and Residue of my Money and Securities for Money Goods Household Goods Stocks personal Estate and Effects whatsoever and wheresoever and of what Nature of kind soever I give and bequeath the same and every part thereof unto my said Daughter Alice Mayne and I do hereby nominate constitute and appoint my said Son in Law Samuel Cleaver full and sole Executor of this my last Will and Testament hereby revoking all former Will by me at any time heretofore made

Whereas I John Mayne of Winslow in the County of Bucks Butcher have made my last Will and Testament in writing duly executed and attested whereby (amongst other Things therein mentioned) I did give and bequeath unto my Son Robert Mayne of Winslow Aforesaid the Sum of one hundred and forty pounds And whereas Since the making and Executing of my said Will my said Son Robert Mayne hath departed this Life Now therefore I do by this my Codicil to be annexed to my said Will give and dispose of the said Sum of one hundred and forty pounds so given and devised unto my said Son Robert Mayne . . . unto my Daughter  in Law Penelope Mayne Widow of my said Son Robert Mayne the Sum of Eighty pounds . . . to be paid to her within twelve Calendar Months next after my Decease Also I give and bequeath unto the six Children of my said Son Robert Mayne ten pounds apiece . . . to be paid to them when they shall respectively attain their Ages of Twenty one years . . . and I do hereby charge my Real Estate to and with the payment of these said several Legacies . . . as in my said Will is mentioned And I do ratify and confirm all and every the Gifts Devises and Bequests in and by my said Will made and given not hereby altered and declare this Writing to be a Codicil to my said Will and to be accepted and taken as part thereof as fully and effectually to all Intents and purposes as if the same had actually been inserted therein In Witness whereof I the said John Mayne have to this my last Will and Testament set my hand and seal this Twelfth Day of March in the year of our Lord one thousand Eight hundred and two - John Mayne [signature]

This writing was signed and sealed by the above named John Mayne and by him published and declared as a Codicil to be annexed to his last Will and Testament in the presence of us who have hereunto subscribed our Names as Witnesses thereto in his presence Lan(celo)t Wyatt John Cox James Varney [signatures]

This Will was proved at London with a Codicil on the Eleventh Day of May in the year of our Lord one thousand eight hundred and three before the worshipful Sherrard Beaumont Burnaby Doctor of Laws Surrogate of the Right Honourable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the prerogative Court of Canterbury lawfully Constituted by the oath of Samuel Cleaver Esquire the sole Executor named in the said Will to whom administration was granted of all and singular the Goods Chattels and Credits of the said deceased having been sworn duly to administer.


Notes

John Mayne was baptised in 1726, son of another John who died in 1732. His mother, as Dorothy Eeles, kept the Crooked Billet (7 Horn Street) until 1780. It was the dwelling house with butcher's shop, cellar, brewhouse, barn and stable which John insured for £300 in 1777. He then kept it until he died. His daughter Alice, who must have run it with him, inherited it in 1803 along with some copyhold land in Granborough.

John Mayne's wife was named Mary. She died in 1794. Children:

TO BE SOLD by AUCTION by JOSEPH DUDLEY, On Wednesday the 6th day of April, 1803, at the late Dwelling-House of Mr. John Mayne, Butcher, at WINSLOW, in the County of Bucks, called or known by the Sign of the Crooked Billet.
ALL the LIVE and DEAD STOCK, HOUSEHOLD-FURNITURE, and EFFECTS of the said Mr Mayne, comprising six Cows, six Calves, three stout Draught Horses, one Nag Mare, in Foal; two Stumps of prime Hay; a large quantity of Dung; two Carts; Horse Harness, &c &c
Household Furniture, such as Four-post sacking-bottom Bedsteads, with neat Furniture, Feather and Flock Beds, Blankets and Quilts, Tables and Chairs, Pewter, Brass and Copper, with various other Articles.
The Sale will begin exactly at Ten o’Clock, as the whole, if possible, will be sold in one Day.

[Also a 7-acre close of pasture at Granborough, and on 29 June the grass growing on Hollow-Furrow and Hanging-Stile Closes]


Will of Alice Mayne, spinster, 1803

This is the last Will and Testament of me Alice Mayne of Winslow in the County of Bucks Spinster I give unto my Nephew John Harris son of my late sister Dorothy Harris of Winslow aforesaid the sum of Forty pounds to be paid him when he shall attain the Age of Twenty one years  I give unto my Niece Sarah Harris Daughter of my said Sister Dorothy Harris all my Household Goods Furniture wearing Apparel Plate Linen China and all the Rest Residue and Remainder of my personal Estate and Effects which I shall be possessed of at the Time of my decease to and for her own use and Benefit when and so soon as she shall attain her Age of Twenty one Years and if either of them . . .  die before he or she shall attain the Age of twenty one years then I give the property intended for him or her so dying to the Survivor of them at his or her attaining the Age of Twenty one years but if both of them . . . shall die before they attain their said Ages of Twenty one years then I give all the property so intended unto the Children of my late Brother Robert Mayne of Winslow aforesaid equally to be divided between them share and share alike and to their respective executors Adm(inistrat)ors Assigns to and for their own use and Benefit absolutely. And as to all my Freehold and Copyhold Messuages Lands Tenements and Hereditaments whatsoever and wheresoever and which Copyhold premises I have duly surrendered to the use of this my last Will and Testament I give  and devise the same unto my said Niece Sarah Harris . . . and to her Heirs and Assigns forever but in case she shall happen to die under the Age of Twenty one years and without Issue then I give and devise my said Freehold . . . unto my said Nephew John Harris and his Heirs and Assigns forever. But in case my said Nephew and Niece shall both happen to die under the Age of Twenty one years without Issue then I give and devise all my said Freehold . . . with their Appurtenances unto the Children of my late Brother Robert Mayne their Heirs and Assigns forever equally to be divided . . . and I do hereby nominate constitute and appoint Samuel Cleaver of Gate Street Lincolns Inn fields in the County of Middlesex sole Executrix [sic] of this my last Will and Testament hereby revoking all former Wills by me made and I do hereby authorise and empower my said Executor to sell and convert into Money all or any part of my said Freehold or Copyhold or Personal Estate and Effects if he shall think it beneficial for my said Devisees and Legatees so to do and to place out and invest the Monies arising therefrom in his Name in Government or Real Securities for the Benefit of the person or persons who would have been entitled to the property so sold under this my Will If no such sale had been made And I do hereby declare that the receipt or receipts of the said Samuel Cleaver shall be a sufficient discharge . . . to any person who shall become the purchaser or all or any part of my Estate and Effects and that no such purchaser . . . shall become answerable or accountable for any misapplication or non application of his . . . purchase Monies or in any manner bound to see to the application thereof  In Witness whereof I have hereunto set my hand and seal this fifth Day of March in the year of our Lord one thousand Eight hundred and three Alice Mayne [signature]
