[p.1] This is the last Will and Testament of me Edward Williatt Jones of Winslow in the County of Bucks yeoman  First I give and devise unto my Brother Robert Williatt Jones all and every my freehold copyhold and all other Messuages Closes Lands tenements hereditaments and premises situate standing lying and being in the parish of Great Horwood in the said County of Bucks with the Commons one six post Hovel one six post Staddle and all other the rights members and appurt(enance)s thereunto \respectively/ belonging or in any wise appertaining (except the Wheathouses standing thereon) and all other my real estate whatsoever To hold the same & every part thereof unto and to the use of the said Robert Williatt Jones his heirs & assigns for ever subject nevertheless to and charged with the payment of the annuity clear yearly rent or Sum of ten pounds payable thereout to my Mother Elizabeth Jones and her Assigns during the term of her natural life and charged thereon by the last Will and Testament of my late Uncle John Jones deceased and also subject to and charged with the payment unto my said mother or her Assigns of one other annuity or clear yearly rent or Sum of ten pounds of lawful British money yearly and every year during the term of her natural life and unto my Sister Mary Ann Jones or her Assigns of one annuity or clear yearly rent of twenty pounds of like lawful money yearly and every year for the term of her natural life which said Annuities I do hereby give and bequeath unto my said Mother and Sister respectively accordingly and direct the same to be paid and payable quarterly on the twenty fifth day of March the twenty fourth day of June the twenty ninth day of September and the twenty fifth day of December in each and every year by even and equal portions the first payments of the said several annuities to begin and be made on such of the said days as shall first and next happen after my decease and in case of nonpayment of the said annuities or either of them or any part thereof respectively for the space of twenty eight days next over or after either of the said days when the same ought to be paid as aforesaid being first lawfully demanded I direct that my said Mother and Sister respectively shall have such and the like remedy for a recovery thereof by distress on my said Estates hereditaments and premises as by Law is given in cases of rent in arrears and in the meantime from and after my decease during the minority of the said Robert Williatt Jones I direct authorize and empower my Trustees and Executors hereinafter named or the

[p.2] survivors or Survivor of them or the Executors Administrators or Assigns of such Survivor to let set and demise the said hereditaments real Estate and premises and to receive the rents issues and profits and to pay and apply and dispose of the same in the first place in paying and discharging the said several Annuities and residue thereof (first deducting the expence of repairs and insurance and all other incidental charges) for the benefit of my said Brother Robert Williatt Jones as they or he shall think proper and in case my said Brother Robert Williatt Jones shall die under the age of twenty one years and without issue or if he shall die after having attained the age of twenty one years without issue and without having been admitted to the Copyhold parts of my said Estates hereditaments and premises then and in either of such cases from & after the decease of my said Brother Robert Williatt Jones I give and devise the said freehold and Copyhold and other Messuages Closes Lands Tenements hereditaments and premises with the Commons hovel Staddle and Appurtenances thereto belonging unto my Brother Newman Jones to hold the same and every part thereof unto and to the use of my said Brother Newman Jones his heirs and Assigns for ever subject to and charged with the payment of the several annuities hereinbefore mentioned and also subject to and charged with the payment within twelve Calendar months after the decease of the said Robert Williatt Jones of the Legacy or Sum of five hundred pounds of lawful money aforesaid unto my Brother Thomas Jones if he shall be then living to whom I do hereby contingently give and bequeath the same accordingly in case my said Brother Thomas Jones shall not be living at the time of the decease of the said Robert Williatt Jones then subject to and charged with payment of the like Sum of five hundred pounds unto and among all and every the Children of the said Thomas Jones equally part and share alike as and when they shall severally and respectively attain the age of twenty one years with benefit of Survivorship amongst them as to the share or shares of either or any of them dying under that age and without issue the interest thereof in the mean time at the rate of four pounds per centum per annum to be received by my Executors and trustees hereinafter named or the Survivors or a Survivor of them or the Executors Administrators or Assigns of such Survivor and applied as they or he shall think fit for the benefit of such Children during their respective minorities Also I give and bequeath unto my Brother Thomas Jones the legacy or Sum of three hundred pounds which was in and by the Will of my said late Uncle John Jones deceased directed to be paid by him to me out of an Estate at Singleborough in the parish of Great Horwood aforesaid  in and by the said Will given and devised to the said Thomas Jones in the event which happened of my Brother Williatt Jones dying the age of [sic] twenty one years and without issue (exclusive of the interest which may be due for the same at the time of my decease which interest I direct shall be considered as part of the residue of my personal estate and effects hereinafter given and bequeathed) Also I give and bequeath unto my said Brother Newman Jones the Sum of two hundred pounds secured to be paid to me after the decease of my said Mother Elizabeth Jones  in and by a Settlement some years since executed by her and my late Father of certain hereditaments in the several Parishes of Winslow aforesaid and Grandborough in the said County of Bucks and all and every other Sum and Sums of money or parts and shares thereof which under and by virtue of the provisions of the same settlement have become or may hereafter become vested in me by reason of the decease or deceases of either or any of my Brothers and Sisters and of which I have a disposing power  Also I give and bequeath unto my said Brother Newman Jones and my friends Samuel Greaves Dudley of Winslow aforesaid Auctioneer and David Thomas Willis of the same place Gentleman the legacy or sum of one hundred pounds of lawful money aforesaid to be raised out of my ready money securities for money and other my personal Estate and Effects hereinafter given and bequeathed at such times and in such proportions as they may think fit Upon trust to pay apply and dispose of the

[p.3] Sum of Fifty pounds or part thereof for the benefit of my Nephew George Jones Emerton the Sum of twenty five pounds other part thereof for the benefit of my Niece Mary Emerton and the Sum of twenty five pounds residue thereof for the benefit of my Niece Elizabeth Emerton either in putting placing or apprenticing them my said Nephew and Nieces respectively in or to some trade business or employment or otherwise for their preferment or advancement in life as to the said Newman Jones Samuel Greaves Dudley and David Thomas Willis or the Survivors or Survivor of them or the Executors or Adm(inistrat)ors of such Survivor shall seem meet and I give and bequeath unto my said Mother Elizabeth Jones all my contingent or expectant estate and interest in or to a legacy or Sum of one hundred pounds in and by the Will of my late Brother Williatt Jones deceased given and bequeathed unto me in the event of my said Brother Williatt Jones dying under the age of twenty one years and without issue and all my ready money and securities for money farming stock both alive and dead and any utensils implements husbandry debts rights credits and all other my personal estate and effects whatsoever and wheresoever and of what nature or kind soever the same may be which I may die possessed of interested in or intitled to and over which I have a disposing power (except such parts thereof as are hereinbefore specifically bequeathed) To hold the same and every part thereof and all my Estate and interest therein and thereto unto my said Mother her executors Administrators or assigns absolutely subject nevertheless to the payment of all such debts I may justly owe at the time of my decease my funeral and testamentary expences the said legacy or Sum of one hundred pounds hereinbefore given and bequeathed to the said Newman Jones Samuel Greaves Dudley and David Thomas Willis upon the trusts aforesaid and to the legacy or Sum of fifty pounds of lawful money … which I hereby give … unto my Sister Sarah Jones and direct to be paid to her within twelve calendar months next after my decease  And I do hereby nominate … my said Brother Newman Jones and the said Samuel Greaves Dudley and David Thomas Willis joint Executors in trust of this my last Will and Testament provided always and my Will and meaning is that said Newman Jones Samuel Greaves Dudley and David Thomas Willis their Executors Administrators and Assigns shall be charged and chargeable only with & for such monies as they shall respectively actually receive by virtue of the trusts hereby in them reposed And that the one of them shall not be answerable for either of the others of them or for the acts deeds neglects receipts or disbursements of either of the others notwithstanding their joining in any receipt or other act for conformity but each of them for himself and for his own acts … only and that they or any or either of them shall not be answerable or accountable for any Banker or Broker or other person with whom and in whose hands any part of the said trust monies shall or may be deposited or lodged for safe custody or otherwise in the execution of the trust or directions hereinbefore contained or for the insufficiency or deficiency of any security or Securities Stocks or funds in or upon which the said trust monies or any part thereof shall be placed out or invested nor for any loss which may happen to the aforesaid trusts monies and promises except the same shall happen or arise by or through their own wilful defaults respectively  And that they … shall and may by and out of the monies which shall or may come to their respective hands by virtue of the trusts or directions of this my Will retain to and reimburse themselves and each other all Costs Charges damages and expences which they respectively shall or may  suffer sustain expend disburse or be put unto in or about the execution or management of all or any of the trusts hereby reposed in them or in respect thereof or thereto  And also that notwithstanding his appointment as a trustee and Executor under this my Will each of them … shall be entitled

[p.4] to his proper fees and charges for any professional business he may transact in the execution of the trusts hereby reposed in them In Witness whereof I the said Edward Williatt Jones the Testator have to the four first sheets of this my last Will and Testament contained in five sheets of paper set my hand only and to this the fifth and last sheet thereof my hand and Seal this fifth day of May in the year of our Lord one thousand eight hundred and thirty seven Edward Williatt Jones [signature] Signed Sealed published and declared by the said Edward Williatt Jones the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses thereof the word “Mother” being first written on erasure in the eleventh line of the third Sheet the word “other” being first interlined between the thirteenth and fourteenth lines of the same sheet and the word “said” being first erased on the twenty sixth twenty seventh and twenty eighth lines of the same sheet Joseph Denton [signature] Char(les) Willis [signature] and John King Jun(io)r

Proved at London 14th May 1838 before the Judge by the oaths of Samuel Greaves Dudley and David Thomas Willis two of the Executors to whom adm(inistrati)on was granted having been first sworn (by Common) duly to Adm(inist)er Power reserved of making the like grant to Newman Jones the Brother the other Exec(utor) when he shall apply for the same.
