ON the Twelfth day of November 1869, the Will of William Hutt late of Winslow in the County of Buckingham, Grocer, deceased, who died on the Thirtieth day of September1869 at Chieveley in the County of Berks, was proved in the District Registry attached to Her Majesty’s Court of Probate at Oxford by the Oaths of Joseph Hutt  of Thrupp in the County of Oxford, Gentleman, the Brother of the Deceased and Henry Warland of Saint Giles Road in the City of Oxford, Grocer, Executors therein named they having been first sworn duly to administer.

It is hereby certified the above is a correct Copy. Dated this Eighteenth day of November 1869.

This is the last Will and Testament of me William Hutt of Winslow in the County of Buckingham Grocer  I devise all the Real Estate of whatever description to which I am or shall at my decease be entitled (except Estates vested in me as Trustee or Mortgagee) And I bequeath all my personal Estate of whatever nature or description unto and to the use of my Brother Joseph Hutt  of Thrupp in the County of Oxford, Gentleman and my Friend Henry Warland of Saint Giles Road in the City of Oxford, Grocer their heirs executors administrators and assigns according to the nature of the property Upon trust that they my said Trustees or Trustee or the survivor of them their heirs executors administrators and assigns of such survivor do and shall as and when they or he shall in their or his uncontrolled discretion think fit sell and absolutely dispose of my Real Estate together or in parcels by Public Auction or Private Contract with power to make any special Conditions as to Title or evidence of Title or otherwise And with power to buy in the premises at any Public sale And to rescind either on terms or gratuitously any Contract And to resell without being answerable for any loss And do and shall convert and get in my said Personal Estate And I direct that my said Trustees or Trustee shall stand possessed as well of all the monies to arise from the sale of my said Real Estate as also the monies to arise from the sale conversion and getting in or otherwise composing my said personal Estate Upon trust to invest the same in the names or name of my said Trustees or Trustee in or upon some or one of the Government stocks funds or securities in Great Britain or at Interest upon Real or Leasehold securities in England or Wales with power from time to time to vary or change the Investment for any other or others of the same or the like kind and to repeat such change as often as occasion shall require or such Trustees or Trustee shall think proper And upon further trust to pay the annual Income of the said Trust monies or premises or of the stocks funds or securities whereon the same shall be invested unto my dear Wife Elizabeth during her Widowhood and from and after the decease or second marriage of my Wife (which shall first happen) as to as well the capital of the said Trust monies and premises and the stocks funds or securities whereon the same shall be invested as the annual income thereof thenceforth to accrue due Upon trust for such of the following persons namely my Son or reputed Son Herbert William Hutt and my Children Percy John Hutt Bessie Selwood Hutt and Edith Mary Elizabeth Hutt and of all and every my other children or child hereafter to be born as either before or after my decease or before or after the determination of any of the preceding Trusts shall attain the age of Twenty one years or marry under that age with the previous consent of his her or their Guardians or Guardian which shall first happen And if more than one equally with power for my Trustees or Trustee after the decease or second marriage of my said Wife (which shall first happen) to apply the whole or any part of the annual Income of the presumptive share of each of the said four lastly mentioned persons and of each child of mine for his or her maintenance and education And such Trustees or Trustee accumulating the unapplied income (if any) of such share by investing the same in manner aforesaid and disposing the accumulation as part of the same share And also with full power to such Trustees or Trustee with consent in writing from my said Wife whilst living and unmarried and after her  decease or second marriage (which shall first happen) at their or his discretion apply so much not exceeding one half as such Trustees or Trustee shall think fit of each of the said Four lastly mentioned persons and of each child of mine whether vested or contingent for his or her maintenance and education or for his or her advancement in life or otherwise for his or her benefit . . . I appoint the said Joseph Hutt and Henry Warland Executors and Trustees of this my Will and Guardians of my said three children and of all other my Infant Children during their respective minorities And (so far as I can) I also appoint  said Joseph Hutt and Henry Warland Guardians of my said Son or reputed Son Herbert William Hutt during his minority I hereby revoke all former and other Wills As Witness my hand this Thirteenth day of August in the year of our Lord One thousand eight hundred and sixty nine William Hutt [signature]

The Testator William Hutt was late of Winslow in the County of Buckingham, Grocer, and died on the Thirtieth day of September1869 at Chieveley in the County of Berks.

Notes

William Hutt came to Winslow in 1866 when he took over Elizabeth Monk's grocery shop in the Church Houses. His widow Elizabeth carried on the business, and she later married Charles Wilford.

In 1861 William was a farmer at Ramsden, Shipton under Wychwood, Oxon. He was born at Bletchington. He married Elizabeth Selwood in 1858 in London. This was apparently after their eldest son was born.
