Will of John Woodward of Shipton, farmer, 1875 (proved 1880)

This is the last Will and Testament of me John Woodward of Shipton in the parish of Winslow in the County of Bucks Farmer.  I devise and bequeath all the real estate to which I shall be beneficially entitled at the time of my decease or of which I shall have any power of appointment or disposal unto my two Brothers Francis Woodward and Thomas Woodward their heirs executors administrators and assigns absolutely in equal shares and proportions as tenants in common and not as joint tenants Subject nevertheless to their paying out of my personal estate to my Sister Ann the Legacy or sum of Six hundred pounds within six calendar months next after my decease. I devise all the real estate which shall at my decease be vested in me upon trust or by way of Mortgage to my said Brothers Francis Woodward and Thomas Woodward their heirs and assigns subject to the trusts and equities affecting the same respectively. I appoint my said Brothers Francis Woodward and Thomas Woodward Executors of my Will and revoke all other Wills. In Witness whereof I the said John Woodward the Testator have hereunto set my hand this Nineteenth day of March One thousand eight hundred and seventy five.

Signed by the said John Woodward the Testator in the joint presence of us who at his request in his presence and the presence of each other have hereunto subscribed our names as Witnesses. The words “  in equal shares and proportions as tenants in common and not as joint tenants” being first interlined between the eighth and ninth lines from the top hereof.

ON the Twenty ninth day of January 1880, the Will of John Woodward late of Shipton in the parish of Winslow in the County of Buckingham, Farmer, who died on the Twenty eighth day of February 1879, at Shipton aforesaid, was proved in Her Majesty’s High Court of Justice in  the District Registry attached to Probate Division thereof at Oxford by the Oaths of Francis Woodward of Holcombe in the Parish of Swanbourne, in the County of Buckingham, Farmer, and Thomas Woodward of Shipton aforesaid, Farmer, the Brothers of the deceased, the Executors named (in the said Will) they having been first sworn duly to administer.
It is hereby certified the above is a correct Copy. Dated this Fifth day of February 1880.

Notes

John Woodward ran Red Hall Farm with his sister Ann (d.1884) as a tenant of the Selby-Lowndes estate. After he died it was taken over by his brother Thomas (d.1893), while the other brother Francis was tenant of Holcombe Farm. They were originally from Swanbourne.
