Will of Robert Eden, carpenter, 1771

The probate of this will can’t be traced but it was recorded in the manor court book when the testator's son came of age, and the following marginal notes were added in a much later hand:

Also at this Court the Homage aforesaid upon their oath present that William [=Robert] Eden late of Winslow Carpenter deceased late one of the Customary Tenants of this Manor who whilst he lived held to him and his Heirs of this Manor by copy of Court Roll Fealty Suit of Court and the yearly rent of [blank] All that Messuage or Tenement wherein he dwelt in Sheep Street in the Parish of Winslow aforesaid with the appurtenances Died sometime since so seized thereof and that he the said William [=Robert] Eden by his Last Will and Testament in Writing bearing the date the Twenty third Day of November One Thousand Seven Hundred and Eighty one [=1771] gave and bequeathed unto his Wife Anna Maria Eden All that said Messuage or Tenement wherein he then dwelt situate in Sheep Street in Winslow together with all and singular all the appurtenances thereunto belonging To hold to his Wife Anna Maria Eden until such time as his Son Robert Eden shall attain the full Age of five and twenty years and after he should attain the said Age of five and twenty years Then the said Testator further gave and bequeathed All his said Messuage or Tenement together with all and singular Houses Outhouses Edifices Buildings Barns Yards Gardens Orchards Backsides and Appurtenances whatsoever thereunto belonging or appertaining unto his said Son Robert Eden his Heirs and Assigns for ever (except as thereinafter is excepted) that is to say his Will Meaning and Desire was that his said Wife Anna Maria Eden should have and enjoy for the Term of her natural Life or Widowhood the Parlour and the rooms over the same, the Little Barn and both the two Gardens and the Lower Room in the new Bay when built where the Chimney is to be erected belonging to the said Messuage or Tenement to live and lodge in with Ingress Egress Way and Passage into and out of the same Subject nevertheless and he did thereby charge all his said Messuage or Tenement with the payment of one annuity clear yearly Rent or Sum of Twenty Shillings of lawful Money of Great Britain unto his said Wife Anna Maria for and during the Term of her natural Life or Widowhood free of all taxes and all other Deductions whatsoever to be issuing and payable by her said Son Robert Eden out of the said Messuage or Tenement and to be paid and payable by half yearly payments at the two most usual Feasts or Days of Payment during the year That is to say the Feast of the Annunciation of the Blessed Virgin Mary and St Michael the Archangel the first payment to begin on such of the said Feasts as should first and next happen after his Son should attain his full Age of five and twenty years and come into Possession of the said Messuage or Tenement as aforesaid Also subject to the payment of Ten Pounds of lawful money unto his Son Thomas Eden after the decease of Anna Maria the said Testator’s Wife and he did thereby also charge his said Messuage or Tenement with the \true/ payment of the same

Now to this Court comes the said Robert Eden in his own proper person having attained his said Age of Twenty Five years and desires of the Lord of this Manor to be admitted Tenant to the premises aforesaid To Whom the Lord of this Manor by the Hands of his said Steward grants seizin thereof by the Rod To have and to hold the premises aforesaid with the appurtenances unto the said Robert Eden his Heirs and Assigns for ever Subject and Charged as aforesaid Of the Lord by the Rod at the Will of the Lord according to the Custom of the said Manor by the yearly rent of [blank] Fealty Suit of Court and other Services and Customs therefore due and of Right accustomed and he gives to the lord for a Fine for such his Estate so to be had in the premises [blank] and he is thereof admitted Tenant &c and his Fealty is respected until &c


Notes

Robert Eden was probably the son of Robert and Ann, bap. 15 Oct 1727 (but there were several people with the same name). The 1752 manor court refers to the mortgage in 1747 of "a messuage in Sheep Street then in the occupation of Robert Eden (now deceased)". By 1754, "Robert Eden of Winslow, Carpenter" had a wife called Ann, presumably the Anna Maria referred to here. Their son Robert must have been born in 1759.

The messuage could be this one referred to in 1700: "Robert Eden jr died seised of a messuage in Winslowe. Robert Eden is his son and nearest heir and under the age of 14." The location in Sheep Street hasn't yet been identified.

Robert Eden's death was reported at the 1772 manor court: "He held by rent of 4d a messuage wherein he dwelt in Sheep Street". Anna Maria his widow was admitted tenant until Robert his son was 25.
