Will of Edmund Bentley, retired huntsman, 1900 (proved 1904)

This is the last Will and Testament of me Edmund Bentley late of Whaddon in the County of Bucks Hunts man and now of Winslow in the said County of no occupation.  I appoint my Son Edmund William Bentley and my Niece  Elizabeth Ellen Smith of Winslow aforesaid Spinster (hereinafter referred to as “my said Trustees”) Executor and Executrix and Trustees of this my Will I give all my household goods and furniture plate linen china glass fuel consumable stores and other articles of household effects unto my said Niece Elizabeth Ellen Smith so long as she shall remain single and unmarried and shall provide a home for my unmarried children as hereinafter mentioned I bequeath all my shares in The Bucks and Oxon Union Bank Limited unto my five children equally as tenants in common I bequeath all money invested by me in the London and County Banking Company Limited The National Provincial Bank of England Limited, The Alliance Assurance Company and Bryant and Mays Limited and any money I may have on deposit at The Bucks and Oxon Union Bank Limited at the time of my death unto my said Trustees upon trust to sell call in and convert the same into money and to invest the moneys arising from such sale calling in and conversion with power for my said Trustees from time to time at their discretion to vary such investments And to stand possessed of the said moneys and investments for the time being representing the same Upon trust to receive the annual income arising therefrom and to pay the same to my said Niece Elizabeth Ellen Smith so long as she shall remain single and unmarried (subject nevertheless to my said Niece Elizabeth Ellen Smith providing a home for herself and for such of my unmarried children as shall desire the same) And in the event of the marriage of to my said Niece Elizabeth Ellen Smith I give my said Household goods furniture and effects unto my then unmarried children equally and direct  my said Trustees to stand possessed of the said moneys and the investments for the time being representing the same Upon trust to divide the same unto and equally between and among my said Niece Elizabeth Ellen Smith and my said five children But in the event of the decease of my said Niece Elizabeth Ellen Smith while single
[p.2] and unmarried I direct my said Trustees to divide my said household goods furniture and effects unto and equally among and between my unmarried children absolutely and as to the said moneys and the investments for the time being representing the same to divide the same unto and equally between my said five children absolutely I devise all the real estate and I bequeath the residue of the personal estate to which I shall be entitled at the time of my decease including the Insurance money to be received from the Hunt Servants Benefit Society unto my said Trustees Upon trust to sell call in and convert the same into money and after paying thereout the expenses attending such sale calling in and conversion my just debts my funeral and testamentary expenses and the legacy or sum of Twenty pounds to my Sister Esther Bentley and the legacy or sum of Five pounds to each of my Sisters Emma Bennett Frances Wootton and  Elizabeth Colpus which said legacies I do hereby bequeath to my said Sisters accordingly Upon trust to divide the balance then remaining unto and equally among and between my said Niece Elizabeth Ellen Smith and my said five children absolutely I declare that in the event of the decease of either of my said five children prior to any money in which such child may be entitled to share under this my Will becoming divisible leaving issue such issue shall take and if more than one equally between them the share to which his her or their parent would have been entitled if living at the time of my decease And I also declare that all moneys liable to be invested under this my Will may be invested in any Stock Funds or securities authorised by law for trust funds or in the purchase of inscribed Stock of any British Colony or on Mortgage of real securities in England Lastly I revoke all other Wills  In witness whereof I the said Edmund Bentley the Testator have hereunto set my hand this Fifth day of May One thousand nine hundred

On the Seventh day of January 1905. Probate of this Will was granted at Oxford to Edmund William Bentley the Son and Elizabeth Ellen Smith Spinster, the Niece the Executors.

It is hereby certified that the foregoing is a correct Copy
Dated this Twelfth day of January 1905.

BE IT KNOWN that Edmund Bentley formerly of Whaddon in the County of Buckingham, now of Winslow in the same County, Huntsman, who at the time of his death had a fixed place of abode at Winslow aforesaid, within the district of the Counties of Oxford, Berks and Buckingham, died on the 3rd  day of October 1904 at Winslow aforesaid. 
AND BE IT FURTHER KNOWN  that at the date hereunder written the last will and Testament of the said deceased was proved and registered in the District Probate Registry of His Majesty’s High Court of Justice at Oxford, and that administration of all the estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to Edmund William Bentley of Wing in the County of Buckingham, Second Horseman, the Son of the deceased and Elizabeth Ellen Smith of Winslow aforesaid, Spinster, the Niece of the deceased, the Executors.

Notes

Edmund Bentley was born at Coulsdon, Surrey. In the 1901 Census he was a widower aged 61 living at 14 Buckingham Road with his daughter Alice aged 23 (born at Whaddon) and niece Elizabeth Smith aged 49 (born at Luton; she remained in the house until she died in 1929). He was living at Whaddon Kennels in 1891 and evidently retired to Winslow.
